In the instant petition, petitioners have prayed for the following relief:- For a direction to the respondent circle officer to mutate the land of petitioners in the light of judgment dt. 18.09.2019 and decree dt.
26.09.2019 passed in the title suit no.
201/2017 by the Ld. Munsif-I, Madhepura with respect to the land situated at Mauza-Lakshimpur
Patna High Court CWJC No.11759 of 2025 dt.24-07-2025 2/3 Bhagwati, Thana No. 298, Khata No.
404, Khesra-681, Area-44 Decimil and other situated at Mauza-Sahoriya Bala, Thana No. 295, Khata No. 307, Khesra720, 721 & 723 Area-26 Dicmil, 41 dicmil and 20 dicmil respectively, Total ; Area of land 1 acre 31 dicmil.
(ii) To grant any other relief/reliefs for which the petitioner he entitle to get in the eye of law.
2. Learned counsel for the petitioners submits that title suit no. 201/2017 has been decided by the Civil Court in the light of judgment dated 18.09.2019 and decree dated 26.09.2019. The said judgment and decree pertains to the land situated at Mauza-Lakshimpur Bhagwati, Thana No. 298, Khata No. 404, Khesra-681, Area-44 decimal and other situated at Mauza-Sahoriya Bala, Thana No. 295, Khata No. 307, Khesra720, 721 & 723 Area-26 decimal, 41 decimal and 20 decimal respectively, total area of land 1 acre 31 decimal. It is further submitted that pursuant to the said decree and judgment, petitioners have filed petition for the mutation of the aforesaid land but the Circle Officer, Kumarkhand has not taken any decision in the light of the judgment and decree passed by the Civil Court.
3. Learned counsel on behalf of the State has submitted that if petitioners file fresh application for the mutation of the land in question, the Circle Officer, Kumarkhand will look into

Considering the facts and circumstances of the case and the arguments advanced on behalf of the parties, the present writ petition is disposed of with liberty to the petitioners to file fresh application for mutation of the land in question before the Circle Officer, Kumarkhand, on the grounds which has been raised by the petitioners in the present writ petition, within a period of four weeks from the date of receipt of the order. If such application is filed within the stipulated period, the concerned authority will pass an appropriate order, in accordance with law, after giving due opportunity of hearing to the parties concerned expeditiously, preferably, within a period of three months from the date of receipt of the order, without being prejudiced by the order passed by this Court.
