JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-01-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioners apprehend their arrest in connection with Araria P.S. Case No. 540 of 2016 for the offences punishable under sections 341, 323, 379, 504 and 506/34 of the I.P.C.

Allegedly, the petitioners snatched cash of Rs. 1,60,000/-, key of the motorcycle and the mobile from the informant.

Submission is of false implication and that during investigation it has come that the informant has taken four acres of land on lease of accused Narad Yadav at the rate of Rs. 18,000/-

Patna High Court Cr.Misc. No.51481 of 2016 (3) dt.19-01-2017 2/2 per year and there was dues of Rs. 34,000/-, but the informant told the accused to keep his motorcycle till he did not pay the amount of Rs. 34,000/-, vide paragraphs- 7, 8, 9 and 10 of the case diary, no offence as alleged is made out and as such the petitioners deserve sympathetic consideration.

The learned A.P.P. submits that the petitioners are named in the FIR but during investigation the independent witnesses have not supported the prosecution version. In the facts and circumstances as stated above, considering the statement of the independent witnesses, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Araria in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
