JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-01-2015 Heard learned Sr. Counsel for the petitioners and learned counsel representing the State.
Petitioners apprehend their arrest in connection with Dumraon P.S. Case No. 173 of 2014 registered for the offences punishable under Sections 341, 323, 386, 420, 467, 468, 471, 120B/34 of the Indian Penal Code.
From the impugned order it reveals that the informant has appeared before the learned Sessions Judge with his
Patna High Court Cr.Misc. No.30619 of 2014 (2) dt.22-01-2015 learned counsel and asserted that the case has been compromised on the terms that earlier liability was fixed by the informant will not be binding upon him.
It is submitted that in view of the compromise, the informant has no any complaint now against the petitioners. In the facts and circumstances stated above, the petitioners are directed to surrender before the court below and the court below after ascertaining the genuineness of the compromise and finding it genuine, shall release the petitioners on bail on execution of bail bond to its own satisfaction on the same day. With the aforesaid direction this application is hereby disposed of.
