====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-09-2019 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 302 and 228/34 of the Indian Penal Code.

According to FIR, petitioner no. 1 had extra marital relation with the daughter-in-law of the informant and just to maintain his relationship, the accused persons wanted to commit murder of the son of the informant. On one occasion, the son of the informant had came to his village and saw both in a compromising position. Thereafter, the accused persons allegedly committed assault to the son of the informant and administered poison.

Patna High Court CR. MISC. No.44661 of 2019 (3) dt.27-09-2019 2/2 Petitioner no. 2 is mother of petitioner no. 1. The Doctor has not found any external injury on the dead body and viscera report is still awaited. Submission is that there is no eyewitness of the actual occurrence. Only on suspicion, everything has been stated to the police. Investigation of the case is already complete against the petitioner.

Considering the facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ladaniya Police Station Case No. 51 of 2019, subject to the following conditions:- (a) The petitioners shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioners. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
