This application is for grant of regular bail in connection with Kotwali P.S.Case No.348 of 2017, for the offences punishable under Sections 408, 409, 418, 419, 420 & 120B of the Indian Penal Code.

Allegation against the petitioner is about withdrawal of Rs.39 lac from the account of other accused persons. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and in spite of that he is ready to deposit the amount if some reasonable time is granted to him. The petitioner is in custody for about four months. Heard learned A.P.P. also.

No.49911 of 2017 (3) dt.09-11-2017 2/3 Having heard both sides and in view of facts and circumstances and the undertakings of the petitioner as stated above, this application is disposed of with direction to the learned trial court that once the petitioner files bank draft of Rs.13 lac before learned trial court, on being satisfied with the same, he will release the petitioner on provisional bail in connection with Kotwali P.S.case No.348 of 2017 to his own satisfaction and the petitioner will continue to deposit rest amount in two equal instalment of Rs.13 lac each just after three months of first installment and thereafter, next instalment also after three months of the second instalment and if the court is satisfied with the deposit of the whole amount, he will confirm the bail bond of the petitioner, otherwise, bail bond of the petitioner shall be cancelled. Needless to say that deposit of amount shall be subject to result of the case and may be released in favour of O.P.No.2, if such application is filed.

With the aforesaid observation, this application is disposed of.
