The petitioner being husband of the complainant is apprehending arrest in a complaint case wherein process has been issued after cognizance being taken under sections 498A and 379 of the Indian Penal Code and section 4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.

Learned counsel for the petitioner submits that the petitioner admits his marriage with the complainant in 2002 and is ready to keep her with full dignity and honour. Statement to that effect has been made in paragraph 12 of the petition which reads as follows:

Patna High Court Cr.Misc. No.47113 of 2016 (2) dt.27-10-2016 2/2 "That the petitioner being the husband is ready to keep the opposite party no. 2 as his wife with full dignity and honour." Considering the fact that the complaint was filed 2007, this court is not inclined to interfere in the matter. However, keeping in view the present stand of the petitioner, it is a case for consideration of the prayer for bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Complaint Case No. 266 of 2007 pending in the court of learned SDJM, Bikramganj.

This application is disposed of with the aforesaid observation/direction.
