Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 08-04-2022 Heard learned counsel for the petitioners and learned APP for the State via virtual mode.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 342, 363 and 367 of the Indian Penal Code.
As per allegation in the FIR is that both the petitioners had employed two minor sons of the informant and whenever informant came to meet his children, he was not allowed to meet them and one of the informant's son any how managed to escape from the clutches of petitioners home but petitioners did not release the informant second son.
It is submitted by learned counsel for the petitioners
Patna High Court CR. MISC. No.53726 of 2021(2) dt.08-04-2022 2/3 that the petitioners have falsely been implicated in this case. He further submits that the informant's son came on 22.05.2021 and told about his brother's condition but informant has given information to police after one month on 24.06.2021 and in fact informant's wife was working at the house of petitioners so the petitioner no.1 has good relation with the informant's family. He further submits that about 7-8 years ago, informant's wife has died but petition no.1 continue to monetary help to the informant and on 17.06.2021 one of the informant's son came to the petitioners home and committed theft and fled away for which petitioner no.1 filed a complaint case and thereafter informant put pressure upon petitioners to withdraw the case. Petitioners have got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, East Muzaffarpur in connection with Kaji Mohammadpur P.S. Case
