JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code and section 138 of N.I. Act.

The prosecution case is that the petitioner being a medicine dealer was persuaded by the informant being the employee of Central Bank of India to invest in the Central Bank Karmchari Swablambi Co-operative Limited. The informant deposited Rs.1,24,500 out of which he encashed the cheque of Rs.50,000/- but for encashment of Rs.74,500/- the cheque was issued which got bounced. The petitioner was Secretary of the alleged Cooperative.

Patna High Court Cr.Misc. No.54736 of 2015 (2) dt.04-12-2015 2/2 It is submitted by the learned counsel for the petitioner that the petitioner is ready to deposit Rs.74,500/- before the learned court below.

On deposit of Rs.74,500/-, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi in connection with Sitamarhi (Mehsaul OP) P.S. Case No.299 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C.

The aforesaid amount will be released in favour of the informant if he files separate application for reconciling the issue otherwise the aforesaid amount will be invested in some fixed deposit scheme in connection with the present case which will be subject to the result of the case.
