JUSTICE SUDHIR SINGH ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 307 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against petitioner is to have fired shot upon informant.

It is submitted on behalf of the petitioner that he has falsely been implicated in the present case. There is no allegation of tampering of witnesses against petitioner. The injury is said to be simple in nature. Hence, no offence under Section 307 of the Indian Penal Code is made out. Both parties are agnates. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned
