JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 The petitioner seeks regular bail in connection with Sasaram Rail P.S. Case No. 65 of 2017, registered for offences punishable under Sections 379 and 411 of Indian Penal Code. Allegation against the petitioner that he committed theft in the running train and was caught on chase by the police at platform and one bag was recovered from him.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case, which will appear from the fact that in seizure list, there is no signature of owner of the bag. He has no criminal antecedent and has been in custody for last five months.

Having heard both sides, considering the fact and

No.55093 of 2017 (3) dt.22-11-2017 circumstances of the case and also the fact that petitioner was arrested on chase by the police, at this stage, I am not inclined to release the petitioner on bail rather this application is disposed of with direction to the court below to expedite the trial and try to conclude it within a period of six months and if the trial is not concluded within the aforesaid period and if there is no fault on the part of the petitioner in disposal of trial, the trial court shall release the petitioner on bail to his own satisfaction, with condition that he will cooperate in disposal of trial and shall appear on each and every date.
