The petitioner has preferred this application for grant of regular bail in a case registered under sections 18, 20 and 22 of the N.D.P.S. Act.

As per the prosecution case, on a raid being conducted, it is stated that cultivation being done of opium was found and it transpired that six named accused persons including the petitioner herein were cultivating the same. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such cultivation was being done by the petitioner. No details of the land etc. have been given in the F.I.R. The petitioner is in custody since 25.3.2021 and chargesheet has been submitted in

Patna High Court CR. MISC. No.52579 of 2021(2) dt.09-03-2022 2/2 the case. He has no antecedent under the N.D.P.S. Act. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for more than 11 months, the Court directs the petitioner to be enlarged on bail in connection with N.D.P.S. Case no.48 of 2018 (arising out of Amas P.S. Case no.28 of 2017) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judgecum-Special Judge, N.D.P.S., Gaya.
