The petitioner seeks bail in connection with Mithanpura P.S. Case no. 117 of 2015 registered for the offence punishable under Sections 143, 323, 333, 337, 338, 353, 307 and 120-B of the Indian Penal Code.

Several inmates of Sahid Khudi Ram Bose Central Jail including the petitioner are said to have assaulted the employees of the jail by pelting stones at the instigation of some mischievous inmates and made them injured.

It is submitted by the learned counsel for the petitioner that the allegation levelled against the petitioner is not specific rather omnibus. Two FIR named accused persons

Patna High Court Cr.Misc. No.53731 of 2017 (2) dt.09-11-2017 namely, Mantu Tiwari and Shahid Bharati have been enlarged on bail by the learned Sessions Judge and another FIR named accused namely, Roji Sarkar has been enlarged on bail by a coordinate Bench of this Court vide order dated 16.10.2017 passed in Cr. Misc. no. 47948 of 2015. The petitioner has been languishing in custody since 06.06.2015.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 13th Additional Sessions Judge, Muzaffarpur in connection with Mithanpura P.S. Case no. 117 of 2015.
