The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture.
The petitioner and the complainant are present in the Court.
On the joint prayer of the parties the matter was
Patna High Court Cr.Misc. No.54233 of 2015 (3) dt.08-02-2016 2/3 referred to the Mediation Centre of the Bihar State Legal Services Authority. The report of the Mediator dated 30.01.2016 at Flag 'A' reflects that the issue has been reconciled between the parties.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the complainant and birth of a male child. Both sides are residing together since last three weeks. Hence, the issue has been reconciled between the parties.
The contention of the learned counsel for the petitioner has not been controverted by learned counsel for the complainant.
Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 2008 of 2014 (Trial No. 115 of 2015), subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
