2. The petitioner seeks bail in connection with Mairwa P.S. Case No. 138 of 2025 registered for the offence under Sections 103(1), 3(5) of the BNS.

3. As per the prosecution case, unknown criminal are said to have killed the deceased.

4. The petitioner is in custody since 25.03.2025.

5. Learned counsel for the petitioner has submitted that the petitioner has only been implicated in this case on the basis of suspicion.

6. During investigation, it has come that coaccused Praveen Puri had called the deceased and thereafter the dead body of the deceased has been found.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Siwan/concerned Court below in connection with Mairwa P.S. Case No. 138 of 2025.

2. The petitioner seeks bail in connection with Mairwa P.S. Case No. 138 of 2025 registered for the offence

3. As per the prosecution case, unknown criminal are said to have killed the deceased and the petitioner is said to have called the deceased and taken him away. Thereafter his dead body was recovered.

4. The petitioner is in custody since 25.03.2025.

5. Considering the fact that the petitioner has called the deceased, after which he had gone and subsequently, his dead body was recovered, this Court is not inclined to grant bail to the petitioner.
