The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 306 of the Indian Penal Code.
It is alleged that the daughter of the informant committed suicide since the petitioner with whom she was in love, refused to marry her.
It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the victim was in love with the petitioner. The victim committed suicide when she was asked to prepare tea by the informant. Moreover, there is nothing on record to suggest that the petitioner in any way abated the offence. The impugned order also does not suggest the abatement of the offence by the
Patna High Court Cr.Misc. No.53487 of 2015 (2) dt.24-11-2015 petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Supaul in connection with Chhatapur P.S. Case No. 206 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Dinesh Kumar Singh, J) P.K./- U T
