Petitioner seeks bail in Chiraiya P.S. Case No.338 of 2018 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code.

Counsel for the petitioner submits that both parties are agnate. There is case and counter case between the parties. Instant case is counter blast of Chiraiya P.S. Case No.336 of 2018 lodged by the petitioner against the informant and others. In the instant case, it is alleged that this petitioner assaulted the informant with handle of hand-pump. Injury report has been enclosed as Annexure-3, wherein, only one stitched wound was found on the head of the injured, which was found to be grievous in nature.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sikrahana at Dhaka, East Champaran, in connection with Chiraiya P.S. Case No.338 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
