JUSTICE SATYAVRAT VERMA ORAL ORDER 10-02-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with Dinara P. S. Case No.258 of 2018, instituted for the offences under Section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 15.12.2020 and charge-sheet has been submitted in the case.

Allegation is of looting of Rs.41,686/- from the informant by four unknown criminals.

It is submitted that petitioner is not named in the F.I.R. rather he was arrested in a different case where he was made to confess his crime and participation in the present case.

The learned A.P.P. for the State opposes the bail application and submits that petitioner has six antecedents and if bail is granted to the petitioner, he will delay in proceeding of the trial by not letting the charges to be framed. Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and his name transpired on his own confessional statement, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bikramganj, Rohtas in connection with Dinara P. S. Case No.

258 of 2018, subject to condition that one of the bailers shall be the father of the petitioner namely, Tej Narayan Yadav, with a condition that petitioner will have to mark his attendance before the concerned police station in between 25th to 30th of every month commencing from February, 2022, till the charges are not framed.

Patna High Court CR. MISC. No.52969 of 2021(2) dt.10-02-2022 3/3 charge, the learned Court below will be at liberty to cancel his bail bonds.

The application stands allowed.
