JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-06-2018 The present writ petition has been filed for directing the respondents to grant regular promotion with effect from the date from which the same has become due to them.

The learned counsel for the petitioners submits that though the petitioners were discharging the duty of Executive Engineer and they had also been paid the salary of the Executive Engineer, by the interference of this Court, but still the retiral dues has been calculated on the basis of the salary being paid to the Assistant Engineer. It is further submitted that the juniors to the petitioners have already been promoted on regular basis on the post of Executive Engineer.

Patna High Court CWJC No.12942 of 2010 (6) dt.18-06-2018 2/2 In view of the aforesaid, the petitioners are directed to file a detailed representation before the respondent no. 1 within a period of four weeks from today and the respondent no. 1 shall decide the case of the petitioners for grant of regular promotion on the post of Executive Engineer within a period of four weeks thereafter especially taking into account the fact that the juniors to the petitioners have already been granted promotion. In case, the respondent no. 1 finds favour with the case of the petitioners, the consequential benefits shall be paid within a period of eight weeks thereafter.
