Petitioner has filed this Cr. Misc. petition for grant of regular bail in connection with Begusarai Samho P.S. Case No. 7 of 2018 for the offence instituted under Section 302/34 of the Indian Penal Code and Section 27 of Arms Act. He is in custody since 16.07.2018.

Allegation against petitioner is of firing upon the deceased husband of the informant on the right side of temporal region.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to land dispute. It has been further submitted that in FIR no allegation is made of carrying any arms by petitioner. Allegation

Patna High Court Cr.Misc. No.62838 of 2018(4) dt.10-12-2018 2/2 of causing fire arm injury on right side temporal region is not supported by post mortem report. Son of informant and deceased has not named petitioner in his statement u/s 161 of Cr.P.C. to be present there.

Having heard both sides, in view of the facts and circumstances of the present case, let the petitioner named above be released on bail after framing of charge upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Begusarai, in connection with Begusarai Samho P.S. Case No. 7 of 2018 subject to the conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and his absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel his bail bond.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
