The petitioner apprehends his arrest in Kesariya P.S. Case No.388 of 2018 registered under Sections 363, 366(A) of the Indian Penal Code.
The informant, mother of the victim, alleged that her daughter had gone to the house of her maternal aunt. Petitioner is said to have kidnapped the victim.
The learned counsel for the petitioner submits that the petitioner is innocent. The victim disclosed her aged to be 19 years and stated that she voluntarily left her house and went along with Sunil Sharma(the petitioner) to Nepal. They solemnised marriage in the temple.
Taking into consideration the fact that victim herself
Patna High Court CR. MISC. No.41012 of 2019(2) dt.03-07-2019 2/2 denied the factum of her kidnapping and she disclosed that she voluntarily left her house and went along with the petitioner and solemnised marriage, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 11th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case No.388 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
