The petitioner seeks regular bail in connection with Magadh Medical PS Case No. 128 of 2016 registered for the offences punishable under Section 392 of Indian Penal Code. The accusation levelled against the petitioner is that he has been made an accused upon a confessional statement made by the co-accused pertaining to an incident of snatching of gold chain from the neck of a woman.

The learned counsel for the petitioner submits that there are other cases pending against the petitioner in some of which he has been granted bail. Nonetheless, the petitioner is in custody since 24.08.2016, hence has been suitably punished at the

Patna High Court Cr.Misc. No.49977 of 2017 (2) dt.18-10-2017 2/2 moment. It is further submitted that the charge sheet has already been filed, hence there is no chance of the petitioner interfering in the investigation. The learned counsel for the petitioner further submits that he would deposit a sum of Rs. 25,000/- before the learned trial court for the purposes of securing bail. In the facts and circumstances of the present case, I direct that the petitioner Munna Lala @ Munna Kumar be enlarged on regular bail, if not required in any other case, subject to deposit of Rs. 25,000/- (twenty five thousand) before the trial court in connection with Magadh Medical P.S. Case No. 128 of 2016 and subject to such other conditions which may be imposed by the learned trial court. It is made clear that the deposit of Rs.

25,000/- would be subject to the result of the case. It is further directed that the petitioner would appear before the learned trial court on each and every date fixed in the case and in case of two consecutive default, the privilege of bail granted by the present order would stand withdrawn automatically and the petitioner would be taken into custody forthwith.
