JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard the learned counsel for the petitioner. The petitioner seeks regul ar bail in connection with Barauli P.S. Case No. 50 of 2017 for the offences punishable under Section 379 of the Indian Penal Code.
The allegation in the FIR is that some unknown thief had committed theft of motorcycle of the informant and subsequently, the petitioner is said to be caught with the stolen motorcycle.
The learned counsel for the petitioner submits that the petitioner is in custody since 30.06.2017 and has not committed any offence as alleged in the FIR.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular
Patna High Court Cr.Misc. No.53149 of 2017 (2) dt.09-11-2017 2/2 bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 20,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XIV, Gopalganj in connection with Barauli P.S.
