2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 419, 420, 409/34 of the Indian Penal Code .

As per the prosecution case , this petitioner along with other accused persons, in violation of departmental guidelines, committed irregularity in financial expenses and transferred more money than fixed amount and transferred Rs. 52, 89,229/- Rs. 50, 89,555/- and Rs. 54,72,801/- respectively to Ward No. 06, 09 and 10 whereas the Panchayati Raj department, Government of Bihar has provided only Rs. 12.13 Lakh per ward by its letter No. 269 dated 17.01.2017. 4. Learned counsel for the petitioner submits that at the relevant time , petitioner was Chairman of Ward Execution Committe of Ward No. 6. As per F.I.R., it is clear that there is no allegation that this petitioner got any authority to transfer the amount from Panchayat to concern war Execution Committee , nor there is any allegation that she transferred any money in the account of Ward Execution Committee . It was Mukhiya and Panchayat secretary and engineer of MANREGA who had not followed the government circular and has transferred excess amount in three wards i. e,. Ward No. 6, 9 and 10 for execution of the work . It is not the case of the informant that work in question has not been completed rather all the works allotted to the ward No. 6 has already been completed and as such, no amount was embezzled by this petitioner. Moreover, the case of the petitioner is quite different from the case of Mukhiya and Panchayat Secretary . Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the fact that work in question of Ward No. 6 has already been completed, materials available on record and circumstances of the case , in the event of arrest or

No.42237 of 2025(2) dt.04-08-2025 3/3 surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class Barh Patna in connection with Ghoswari P.S. case No. 02 of 2021 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
