JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-11-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.
The prosecution case is of abducting the minor daughter of the informant by Gaurav Sharma. The petitioners being parents of Gaurav Sharma facilitated abduction.
It is submitted by the learned counsel for the petitioners that for the occurrence of 20.7.2015 the FIR was registered on 23.7.2015 and the thrust of accusation is against Gaurav Sharma who is also traceless. It is further submitted that the petitioners have been roped in the present case simply because they happen to be parents of Gaurav Sharma. Statement has been made in
Patna High Court Cr.Misc. No.51356 of 2015 (2) dt.09-11-2015 2/2 paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Kishanganj in connection with Kishanganj P.S. Case No.292 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
