Apprehending their arrest in Gamharia P.S. Case No. 87 of 2016, registered under section 307 and other allied sections of IPC, the petitioners have filed the present application for grant of anticipatory bail.
Patna High Court Cr.Misc. No.48141 of 2016 (2) dt.15-12-2016 2/3 Learned counsel for the petitioners submits that the FIR was lodged against 112 named persons along with 400500 unknown whereas no specific allegation is levelled except alleging that while the Circle Officer was coming back a mob protesting against the counting of votes obstructed him in discharge of his official duty.
It is stated that several co-accused persons of this case, considering the nature of the allegations, have been granted anticipatory bail vide 03.10.2016, 19.10.2016 and 10.11.2016 passed in Cr. Misc. No. nos. 41993 of 2016, 42642 of 2016 and 47056 of 2016 respectively. It is stated that petitioners have no criminal antecedents to their credit. In the circumstances, let the petitioners named above, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in Gamaharia P.S. Case No. 87 of 2016 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, the petitioners shall appear in person on each date fixed at the trial.
