Learned counsel for the petitioners submits that the application as against petitioner nos. 2 and 3 has become infructuous and as such their application is dismissed as withdrawn.
The petitioner no. 1 apprehends his arrest in Isuapur P.S. Case No. 101 of 2014, registered for the offences punishable under Sections 341, 323, 307, 504, 324/34 of the Indian Penal Code.
Learned counsel for the petitioner while placing the application for anticipatory bail with regard to petitioner no. 1 submits that there is general and omnibus allegation against this petitioner namely Prabhu Rai. The specific allegation is
Patna High Court Cr.Misc. No.48034 of 2014 (3) dt.15-04-2015 against Sri Bhagwan Rai. The petitioner no. 1 has no criminal antecedent.
Considering the aforementioned submission and also the fact that petitioner no. 1 has no criminal antecedent, let the above named petitioner no. 1, in the event of his arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Isuapur P.S. Case No. 101 of 2014, subject to the conditions as laid down under Section 438(2) of the Indian Penal Code. (Anjana Mishra, J) P.K./- U T
