JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Pandarak Police Station Case No. 110 of 2016 registered for the offences punishable under Sections 323, 325, 307, 504, 506/34 of the Indian Penal Code.

Petitioner is said to have given single lathi blow causing head injury to the informant and, after that, it is alleged that co-accused Radhe Shyam started raining lathi to the informant, as a result whereof the informant is said to have sustained injury on his hand, leg and head. The injury report of the informant goes to show that only two injuries were found on his person and first injury was found on parietal region of scalp and

Patna High Court Cr.Misc. No.44803 of 2016 (2) dt.06-12-2016 2/2 second injury was found on his right hand. However, both the aforesaid injuries were found simple in nature. Co-accused Radhe Shayam @ Ganesh Kumar has already been granted privilege of anticipatory bail by the learned Sessions Judge vide order dated 22.09.2016 passed in A.B.P. No. 6289 of 2016. Petitioner appears to be a man of clean antecedent and the alleged occurrence is said to have taken place on account of land dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh, Patna in Pandarak P.S.Case No. 110 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
