Petitioner seeks bail in Raniganj P.S. Case No. 235 of 2015 for the offences punishable under Section 392 of the Indian Penal Code.

Informant has alleged that while he was returning on his motorcycle four unknown persons on two motorcycles stopped him and fled away with his motorcycle. It has been submitted that the name of the petitioner has transpired in this case on the basis of confessional statement of one Nitesh Singh who has been granted bail vide order dated 18.05.2016 in Criminal Miscellaneous No. 15038 of 2016.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.52392 of 2017(2) dt.09-11-2017 2/2 the petitioner has been falsely implicated in this case and nothing has been recovered from the possession of the petitioner. It has been further submitted that no T.I.P. has been conducted. Petitioner is in custody since, 20.07.2017. Learned APP for the State opposes the prayer for bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Araria in connection with Raniganj P.S. Case No. 235 of 2015.
