The petitioner apprehends his arrest in Mahnar P.S. case No. 67/2016 under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant alleged that some verbal altercation and scuffle took place between him and Jagat Narayan Singh while he was passing through the door of Jagat Narayan Singh. The nearby people came and pacified the matter. Thereafter, when the informant was returning along with his son the petitioner is alleged to have fired which hit on the forehead of the informant. The learned counsel for the petitioner submits that there is counter version of the occurrence in which nephew of informant was injured but it appears that fire arm injury is found
Patna High Court Cr.Misc. No.39761 of 2016 (4) dt.10-11-2016 2/2 on the forehead of the informant and allegation of firing is against the petitioner.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
