The petitioner apprehends his arrest in Complaint Case No. 444c of 2013, registered for the offences punishable under Section 406 of the Indian Penal Code.

The complainant alleged that he runs a shop of building materials and the petitioner being a contractor, purchased different articles of building materials but did not make payment. The petitioner issued a cheque of State Bank of India for Rs. 6,50,000/- but the cheque was dishonoured.

Learned counsel for the petitioner submits that the petitioner and the complainant were on business term. There is a dispute between the petitioner and the complainant for payment of

Patna High Court Cr.Misc. No.25843 of 2016 (2) dt.20-08-2016 2/2 price.

On the other hand learned Additional P.P. and learned counsel for the complainant submits that the petitioner gave the cheque which was dishonoured.

Considering the facts aforesaid and the fact that the petitioner and the complainant were on business term in which some disputes arose for payment of price, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Pankaj Pandey, learned Judicial Magistrate 1st Class, Begusarai, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
