The petitioners seek bail in Bhabua P.S. Case No.342 of 2017 registered under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, co-accused Rustam Ansari is said to have assaulted Ravi Kant Pandey and the informant by means of country made pistol while Muslim Ansari resorted firing on Ramdayal Pandey by means of fire arm. It is submitted by learned counsel for the petitioners that there is no allegation of assault against the petitioner no.2Sadam Ansari. So far as the allegation of resorting firing on Ramdayal Pandey is concerned, the said Ramdayal Pandey has

Patna High Court Cr.Misc. No.54187 of 2017 (02) dt.13-12-2017 - 2 - filed another case bearing Bhabua P.S. Case No.346 of 2017 against the petitioners and others. The petitioners have been languishing in custody since 21.07.2017.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No.342 of 2017 (G.R. No.1372/17).
