JUSTICE SANJAY KUMAR ORAL ORDER 17-01-2018 This application has been filed to quash the order dated 26.09.2013 passed by 2nd Additional District Judge, Buxar in Title Appeal No.08 of 2009 whereby and whereunder the learned appellate Court admitted copy of sale deeds dated 16.08.1991 and

Patna High Court CWJC No.25379 of 2013 (2) dt.17-01-2018 2/2 28.06.1991 as exhibits on behalf of the respondents.

2. Heard learned counsel for the petitioner.

3. It appears that the respondents along with others filed Title Suit No.219 of 1996 in the court of Civil Judge, Senior Division, Buxar for declaration that the sale deed dated 16.08.1991 as forged, fabricated and void and also for declaration of his title over the land mentioned in schedule-1 of the plaint. The said suit on contest was decreed in favour of the plaintiff. The said documents were produced by the appellants before the court below and were marked as exhibits. The present documents are the same documents. These documents do not prejudice the petitioner in any way as the same were also got marked from the side of appellants.

4. In view of the above facts, this application is devoid of merit and is dismissed.
