The Manager of the SKS Micro Finance limited instituted the FIR against the petitioner citing him as a Field Officer of the Company Under Sections 409, 420, 467, 468 of the IPC alleging that the petitioner, after verification of the records, was found to have embezzled huge amount of the company which provided to give loan to the loanee. He also did not deposit the collection made from the customer.
Contention of Mr. Mishra is that the Branch Manger in order to get rid of the petitioner, and to appoint a person of his choice has instituted the case. No customer has made any such complaint. In fact, the petitioner has deposited some amount
Patna High Court Cr.Misc. No.52868 of 2015 (3) dt.27-01-2016 2/2 as security deposit which has also been refunded. Mr. Dayal, on the contrary, submitted that the allegation is serious which was supported in course of investigation by witnesses as reflected from the impugned order. Considering the facts and circumstances of the case I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is refused.
The petitioner may surrender and seek regular bail before the learned Court below. In that event the Court below shall consider and dispose of the same on its own merit uninfluenced by the present order.
