The writ petition involves series disputed questions of facts and as such the court is not in a position to decide the hotly contested and seriously disputed questions of fact as the scope of the judicial review is to examine the error indecision making process and not to examine the merit of the case by entering into thicket of controversy.
In view of the above, the writ petition is disposed of with liberty to the petitioner to approach Civil Court for
Patna High Court CWJC No.20507 of 2011(7) dt.22-06-2018 2/2 common law remedy.
