JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and the State.

Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 467, 468, 471, 419, 420/34 of the Indian Penal Code. The prosecution case is that the petitioner received Rs. 1200/- as Old Age Pension Scheme by giving a forged age certificate.

It is submitted by the learned counsel for the petitioner that under misconception the said payment was made by the Panchayat representative. The petitioner is ready to return the amount received by him. Petitioner is accused in one other case being Ben P.S. Case No. 195 of 2015 with accusation under Sections 341, 523, 504, 379/34 of the

Patna High Court Cr.Misc. No.35915 of 2016 (2) dt.07-09-2016 Indian Penal Code, but he is on bail in the said case. Considering the present stand of the petitioner, it is a case for consideration of prayer for bail on surrender within a period of six weeks before the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Ben P.S. Case No. 26 of 2016.

With the above observation this application is disposed of.
