The petitioner seeks bail in connection with Pouthu P.S. Case No.31 of 2007 registered under Section 302 and other Sections of the IPC corresponding to Sessions Trial No.317 of 2009.
The petitioner earlier moved before this Court in this Cr. Misc. No.16236 of 2015 but his prayer for bail was rejected with a direction to the trial Court to conclude the trial within one year. Thereafter, the petitioner again moved this Court on 17.05.2017. Prayer for bail of the petitioner was again rejected directing the trial Court to conclude the trial within four months but the learned counsel for the petitioner submitted that trial could not be
Patna High Court Cr.Misc. No.56365 of 2017 (3) dt.10-01-2018 2/2 concluded, therefore, the petitioner filed this petition. A report was called for. It is reported that all the witnesses have already been examined.
Considering the facts that all the prosecution witnesses have already been examined and the trial is at fag end, I am not inclined to enlarge the petitioner on bail and the same is hereby rejected. (Prabhat Kumar Jha, J) Sanjeev/- U
