Ms. Soni Shrivastava, learned counsel for the petitioner by filing a supplementary affidavit prays for modification of the statement made in paragraph-3 of the application relatable to the antecedent of the petitioner and to submit that there is one other case against the petitioner. Let the supplementary affidavit be kept on record. The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 249 of 2015 for offences punishable under Sections 354(A), 354(B), 354, 354(D), 384 and 387/34 of the Indian Penal Code, Sections 67 and 67(A) of the Information Technology Act and Sections 8 and 12 of the Prevention of Children from Sexual Offences Act.

Patna High Court Cr.Misc. No.52944 of 2015 (3) dt.21-12-2015 The FIR charges the petitioner along with one other of harassing the informant and of demanding money on a threat of circulating her naked photographs. The informant has accepted that she committed theft in her own house to gather money for the purpose. Annexure-2 is a petition filed by the same informant before the court below saying that the dispute is a mistake of fact. She has also mentioned that the petitioner is the brother of her friend.

Although the provision under which the case has been instituted are rather serious but considering the circumstances existing and that it took more than seven months for the informant to institute the case, let the petitioner, namely, Sanjeev Kumar in the event of his arrest or surrender within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge (POCSO Act), Vaishali, Hajipur and/or the court concerned in connection with Hajipur Sadar P.S. Case No. 249 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
