JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-08-2019 Petitioner seeks cancellation of bail granted to O.P.Nos. 2, 3, 4 and 5 by the learned 2nd Addl. Sessions Judge, Araria by order dated 04.08.2018 in A.B.P.No. 1114 of 2018, on the ground that just after grant of bail, opposite party Nos. 2 to 5 assaulted the petitioner and threatened him with dire consequences.
Mr. Mrigendra Kumar, learned counsel for the petitioner submits that petitioner has lodged an informatory petition before the learned Chief Judicial Magistrate, Araria regarding the assault to him by the opposite parties.
Patna High Court CR. MISC. No.62389 of 2018(4) dt.21-08-2019 2/2 Learned counsel for the opposite parties appears and submits that all allegations made against the opposite parties are false and baseless and they have not misused the privilege of bail.
After having heard learned counsel for the parties and taking into consideration the fact that opposite parties have denied the allegation of assault and threatening levelled by the petitioner, I am not inclined to interfere with the impugned order granting bail dated 04.08.2018. Accordingly, the application stands dismissed.
