Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 1, in

Patna High Court CR. MISC. No.37638 of 2022(2) dt.30-11-2022 2/3 Cr. Misc. No. 37638 of 2022, namely, Kamlesh Singh @ Kamlesha Singh @ Kamlesh Kumar Singh S/O Late Dinanath Singh.

Permission is accorded.

Accordingly, the petition with regard to petitioner No. 1 in Cr. Misc. No. 37638 of 2022 is dismissed as withdrawn.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 341, 323, 325, 307, 504, 506/34 of the Indian Penal Code. The prosecution case in nutshell is that during election, petitioners along with other co-accused persons assaulted the informant.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they falsely been implicated in the present case. It is submitted that there is scuffle between the parties during election. It is also submitted that there is counter version of the occurrence

In the facts and circumstance of the case, let the petitioners, above named, except petitioner No. 1, in Cr. Misc. No. 37638 of 2022, namely, Kamlesh Singh @ Kamlesha Singh @ Kamlesh Kumar Singh, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Siwan in connection with Aandar P.S. Case No. 80 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
