The petitioner seeks bail in S.Tr. No. 226/2018, arising out of Khagaria (Muffasil) P.S. Case No. 633/2016, instituted for offences under Section(s) 302, 201 and 120(B)/34 of the Indian Penal Code.
It is alleged by the informant/Chaukidar that he received information about dead body of an unknown man lying in the field at Jhamata Bahiyar. Thereafter informant informed the S.H.O. and reached near the dead body and saw the dead body was covered with soil. The informant raised suspicion that murder might have been committed somewhere else and dead body has been kept in the field.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.76257 of 2018(3) dt.21-01-2019 2/2 petitioner is not named in the written report. His name has come in the confessional statement of co-accused Sujay Singh. Charge-sheet has already been submitted in this case. Petitioner is in custody since 06.04.2018.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Fast Track Court 1st, Khagaria in connection with S.Tr. No. 226/2018, arising out of Khagaria (Muffasil) P.S. Case No. 633/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
