JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sahebpur Kamal PS Case No. 36 of 2015 registered under Sections 328, 302 and 120B/34 of the IPC.
The allegation in brief is that the deceased's wife Sona Devi with the help of parents killed her husband by poisoning while he had gone to his in-law's place.
Learned Counsel for the petitioner submits that the allegation is that the deceased's wife had killed him by poisoning because of some other reasons in between them, the petitioner is father of Sona Devi and the only allegation against him is that he helped her in the crime.
Learned Counsel for the State submits that the allegation is against all the accused persons including the petitioner that they killed the son-in-law by poisoning and FSL report indicates regarding death caused by poisoning. It is also submitted that four witnesses have already been examined.
Having considered the said facts and circumstances, the prayer for bail of the petitioner is presently rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of six months. Snkumar/- (Arun Kumar, J.) U T
