JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and the State. The petitioner is languishing in custody since 18.04.2017 in connection with Fatuha P.S. case no. 121 of 2017, registered under Sections 399 and 402 of the I.P.C and Sections 25(1-b)a, 26/35 of the Arms Act.
One pistol and one live cartridge are said to have been recovered from the possession of the petitioner. It is stated that after his arrest in the present case he was remanded in three cases cited in paragraph no.3 of the bail petition. Mr. Dubey, learned counsel, on instruction, submits that in all the three cases the petitioner has been released on bail. In view of the above, this Court is inclined to release the petitioner on bail. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand)
Patna High Court Cr.Misc. No.50868 of 2017(2) dt.09-11-2017 2/2 with two sureties of the like amount each to the satisfaction of learned 7th Additional District and Sessions Judge, Patnacity /concerned Court, in connection with Sessions Trial No. 567 of 2017 arising out of Fatuha P.S. case no. 121 of 2017, subject to the condition that one of the bailors of the petitioner shall be his own/close family member and no sooner the charges are framed in the case, the petitioner shall appear in person on each date fixed at the trial. In case of default on two consecutive dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure his arrest in accordance with law.
