Petitioners apprehend their arrest in Hisua P.S. Case No.75 of 2019, registered under Section 366(A) of the Indian Penal Code.

The father of the victim disclosed in his fardbeyan that his daughter had gone to coaching institute 19.02.2019 but she did not return. On 20.02.2019 the informant made search of his daughter but during the course of search, the informant came to know that Niranjan Singh and his son Pokhan @ Uday Shankar both the petitioners kidnapped his daughter. Learned counsel for the petitioners submits that the occurrence took place on 19.02.2019 but the informant gave

Patna High Court CR. MISC. No.41559 of 2019(2) dt.05-07-2019 2/2 information after four days of the occurrence. The victim made her statement under Section 164 Cr.P.C. and she disclosed that on being chided by her mother, she had gone to the house of her maternal aunt and she remained there for a week. She denied the factum of her kidnapping as alleged by her father. Taking into consideration the fact that the victim herself denied the factum of her kidnapping as alleged by her father, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Hisua P.S. Case No.75 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
