JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 01-05-2018 The present writ petition has been filed for the following reiefs - "(I) For issuance of an appropriate writ in the nature of CERTIORARI for quashing the order dated 29.04.2013 passed by the respondent no. 3 whereby and whereunder the respondent no. 3 has been pleased to reject the point raised by the petitioner in his complaint dated 17.07.2012 for rejection of award of Kisan Seva Kendra (Retail Outlet) Dealer in favour of the respondent no. 5 as also to award the dealership in favour of the petitioner. (II) For issuance of an appropriate writ in the nature of
CERTIORARI for quashing the final merit list prepared by the Selection Board dated 22.06.2012 prepared by the Selection Committee on the ground that the Selection Board had wrongly allotted 25 marks to the petitioner in place of 35 marks as also 35 marks allotted to the respondent no. 5 in place of 25 marks against capability to provide infrastructure and facility as also the Selection Board did not award any marks to the petitioner against Fixed and Movable Assets.
(III) For issuance of an appropriate writ in the nature of MANDAMUS commanding and directing the respondent Company to produce on record the letter of intent issued in favour of the respondent no. 5 by the Respondent Company with respect to award the dealership for a Kisan Seva Kendra at Nawada Location within the District of Muzaffarpur pursuant to the advertisement published in the daily Hindi News Paper "Dainik Jagaran" dated 20.08.2011 and on production the same may be quashed by issuance of an appropriate writ in the nature of CERTIORARI.
(IV) For issuance of an appropriate writ in the nature of MANDAMUS commanding and directing the Respondent Authorities to award the dealership for Kisan Seva Kendra at Nawada Location within the District of Muzaffarpur to the petitioner.
(V) For issuance of any other appropriate writ/writs, order/orders, direction/directions for which the writ petitioner shall be found entitled under the facts and circumstances of the case."
2. Learned counsel for the petitioner states on
instruction that the grievance of the petitioner has already been redressed and hence the writ petition need not be pressed.
3. Having regard to the stand of the petitioner, the writ petition accordingly stands dismissed.
