The petitioner seeks bail in Channan P.S. Case No.25 of 2017 registered under Section 341, 323, 366 A, 504 and 506/34 of the Indian Penal Code and Section 4/8 of POCSO Act. As per the prosecution case, the petitioner is said to have kidnapped the minor daughter of the informant. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case due to dirty village politics. The victim in her statement under Section 164 Cr.P.C. has not named the petitioner in the occurrence rather has stated that she had gone to the house of her grandmother at Deoghar out of her sweet will and on getting knowledge of the filing of the case

Patna High Court Cr.Misc. No.50436 of 2017 (02) dt.18-10-2017 2/ 2 by her father he regressed to her house. The petitioner has been languishing in custody since 08.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st, Lakhisarai in connection with Channan P.S. Case No.25 of 2017.
