The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Siwan Town P.S. Case no. 276 of 2019 instituted for the offence punishable under Sections 341, 323, 353, 504, 506 and 34 of the Indian Penal Code.

As per allegation in the FIR, petitioner along with four unknown persons entered into the power sub-station and make hindrance in power supply resulting into the loss of Rs. 2,00,000/- to the electricity company. Petitioner also used filthy language and threatened the informant to kill him by calling on his mobile.

Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.2268 of 2021(3) dt.16-11-2021 2/2 has submitted that petitioner is innocent and has been falsely implicated in this case by making a fabricated story. Infact, petitioner along with his co-villagers visited the power substation for requesting him to supply the power but in return, informant placed illegal demand of Rs. 200/- per consumer. Informant has lodged this case to save his skin. Learned APP appearing for the State has opposed the prayer for bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Siwan Town P.S. Case no. 276 of 2019, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan subject to the conditions as laid down under section 438(2) of the Cr.P.C.
