The petitioner apprehends his arrest in connection with Kishanganj P.S. Case No. 348 of 2017 registered under Sections 419, 420, 406, 467, 468, 471, 120B of the Indian Penal Code.

The accusation is that petitioner got opened the insurance policy in the name of Md. Tabasir Alam from Birla Sun Life Insurance Company Ltd. and later on petitioner made an attempt to withdraw the money, showing the death of Md. Tabasir. But on verification, it was detected that Md. Tabasir had already died.

No.63648 of 2018(3) dt.31-01-2019 2/2 The learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case on mere suspicion and no any money was withdrawn by this petitioner. Learned counsel for the petitioner has further submitted that similarly situated co-accused, namely, Habibur Rahman was granted bail by a co-ordinate Bench of this Court in Cri. Misc. No. 61234 of 2017 vide order dated 19.04.2018. Petitioner has no criminal antecedent. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by them within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 348 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) sushma/- U T
