JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Silao P.S. Case No. 167 of 2013 registered for the offence under Sections-408, 420, 468, 471 of the Indian Penal Code. According to prosecution case, the Panchayat Sevak and the Mukhiya defalcated the government money and handed over the same to the petitioner and some others but learned counsel for the petitioner submits that in course of investigation, three accounts were verified by the investigating officer and all the above-said accounts stood in the name of different persons and not in the name of the petitioner.

No.48990 of 2014 (3) dt.19-05-2015 2/2 Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Silao P.S. Case No. 167 of 2013 to the satisfaction of Chief Judicial Magistrate, Bihar Sharif, Nalanda subject to conditions as laid down u/S 438(2) of the Cr. P.C.
