2. The petitioner is apprehending his arrest in connection with Kaluahi P.S. Case No. 193 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 103(1), 3(5) of the BNS, 2023.
3. The allegation in the FIR is that the informant, namely Ram Karan Yadav, was having dinner when his elder daughter-in-law, Bandana Devi (wife of Shyam Yadav), started abusing his wife. Upon this, his younger son, Ghanshyam Yadav, objected to Bandana Devi's conduct and asked her to stop abusing his mother, following which he sent her back to her house. Patna High Court CR. MISC. No.46061 of 2026(2) dt.23-07-2026 2/3 alleged that they came to the informant's house and began assaulting Ghanshyam Yadav and his wife. During the incident, Siwani, daughter of Ghanshyam Yadav, intervened in an attempt to rescue them. She was allegedly assaulted and thereafter killed by being hanged from a ceiling fan with a sari. It is further alleged that the petitioner fled from the place of occurrence after the incident.
4. Learned counsel for the petitioner submits that the informant side and the petitioner's side are closely related family members and that the primary dispute is between the parties. It is submitted that although there is a death of a girl, the petitioner has not been named in the FIR. It is further submitted that, though the FIR contains the names of almost all the family members, the petitioner has been subsequently dragged into the case during the course of investigation. Learned counsel for the petitioner has further drawn the attention of this Court to the impugned order and submits that there is no specific discussion regarding the role attributed to the petitioner. It is submitted that the petitioner happens to be the fufera brother of Bandana Devi, who is the gotani of the mother of the deceased. He further submits that the petitioner has no connection whatsoever with the family affairs of the parties. Lastly, it is submitted that

No.46061 of 2026(2) dt.23-07-2026 3/3 although some unfortunate incident appears to have occurred, a different colour has been given to the actual occurrence with an ulterior motive, which is evident from a bare perusal of the date and time mentioned in the FIR, showing that the FIR was instituted after the post-mortem examination.
5. Learned APP appearing for the State has vehemently opposed the prayer for anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner named above be released on anticipatory bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 20,000/- (Twenty Thousand Rupees) with two sureties of the like amount each of the satisfaction of learned Judicial Magistrate, First Class, Madhubani/concerned court, in connection with Kaluahi P.S. Case No. 193 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS, with further conditions that:- One of the bailors shall be family member of the petitioner.
