Petitioner seeks bail in Kalyanpur P.S. Case No.134 of 2018 instituted for the offence under Section(s) 272, 273 Indian Penal Code, Section 30(a), 38 of the Bihar Prohibition & Excise Act.

It is alleged that 28 bottles foreign liquor each of 750 ML and 52 bottles foreign liquor each of 180 ML was recovered from the Scorpio Vehicle. The petitioner is said to be Driver of the said vehicle.

Counsel for the petitioner submits that he had no knowledge about such foreign liquor.

Petitioner is in custody since 26.08.2018 having

Patna High Court Cr.Misc. No.64530 of 2018 (3) dt.01-11-2018 2/2 clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District Judge-VIcum-Special Judge, Excise, Samastipur, in connection with Kalyanpur P.S. Case No.134 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
